Introduction
Welcome to Umoja Marketplace Africa. We are a curated online consumer electronics retailer based in Nairobi, Kenya. Unlike an open marketplace, every product we sell is sourced and sold by us through authorised and verified channels, so you always know exactly who you are buying from. We stock genuine smartphones, tablets, computers, audio, accessories, wearables, smart TVs, home appliances, gaming products and smart home and networking equipment, and we are an authorised reseller for selected brands including Apple, Samsung and Casio.
These Terms & Conditions govern your use of umojamarketplace.co.ke and every purchase you make from us. Please read them together with our Privacy Policy, Return & Refund Policy and Delivery & Shipping Policy, which form part of these terms.
Acceptance of Terms
By browsing our website, creating an account or placing an order, you accept these Terms & Conditions. If you do not agree with any part of them, please do not use the website or place an order. Nothing in these terms limits any rights you have under Kenyan consumer protection law that cannot lawfully be excluded.
Eligibility to Purchase
To place an order you must be at least 18 years of age. Visitors under 18 are welcome to browse the website under the supervision of a parent or guardian, but orders must be placed by an adult. By ordering, you confirm that the information you provide, including your name, delivery address and contact details, is accurate and complete.
Product Information
We take real care over our product content. Descriptions, specifications and images are prepared from manufacturer information and verified sources, and we sell genuine products only. Minor variations can still occur, for example where a manufacturer updates packaging or a colour appears slightly different on screen, and such variations do not amount to a fault. If compatibility matters to your purchase, for example a charger for a specific laptop or a case for a specific phone, we encourage you to contact us before ordering; our team is available around the clock to confirm compatibility.
Pricing
All prices are displayed in Kenyan Shillings (KES). Umoja Marketplace Africa is not currently registered for VAT, so no VAT is charged on our prices: the price displayed, together with the agreed delivery charge, is the full amount payable. If you require an eTIMS receipt for your purchase, simply let us know when ordering and we will issue one through the Kenya Revenue Authority's eTIMS system. Delivery charges are not shown on the website: once you place your order, our team confirms the delivery charge with you based on your location and the mode of transport, and nothing is dispatched until you have accepted it. Prices may change from time to time, but changes do not affect orders we have already accepted. If a pricing error is obvious and unmistakable, we may cancel the affected order and refund any amount paid in full.
Orders
Placing an order through the website constitutes an offer to purchase. Orders are prepared for dispatch once payment has been received and confirmed. Please check your order details carefully before completing checkout, and contact us immediately if you notice an error; we will do our best to correct it before dispatch.
Order Acceptance
An order is accepted when we confirm dispatch of your items. Until then, order confirmation emails and payment receipts acknowledge your order rather than accept it. We may decline or cancel an order in limited circumstances, for example where payment cannot be confirmed, where stock is unavailable, or where we reasonably suspect fraud. If we cancel an order after payment, we will refund the full amount paid without delay.
Product Availability
All orders are subject to stock availability. Because we curate our range carefully, some items are stocked in limited quantities. If an item becomes unavailable after you order, we will contact you promptly and offer an alternative, a back-order where possible, or a full refund. The choice is always yours.
Delivery
We deliver across Kenya, with same-day delivery available within Nairobi for eligible orders. Full details, including timelines, tracking and what happens if a delivery cannot be completed, are set out in our Delivery & Shipping Policy.
Returns & Refunds
Eligible products may be returned within 3 days of delivery, subject to the conditions in our Return & Refund Policy. That policy explains what qualifies for return, how refunds and replacements are processed, and how defective, incorrect or damaged items are handled.
Manufacturer Warranty
Because we sell genuine products sourced through authorised channels, the manufacturer’s warranty applies where applicable. Warranty periods and coverage vary by brand and product, and are honoured through the manufacturer or its authorised service centres in Kenya. Warranties generally cover manufacturing defects and do not cover accidental damage, liquid damage, misuse, unauthorised repair or normal wear. We are happy to help you understand the warranty position of any product before you buy, and to guide you through a warranty claim after purchase.
Customer Responsibilities
You are responsible for providing accurate order and delivery information, being reachable on the phone number provided, keeping your account credentials confidential, and using products in line with the manufacturer’s instructions. Please inspect your order at delivery and contact us promptly if anything is not as expected.
Intellectual Property
All content on this website, including text, product descriptions, graphics, logos and layout, belongs to Umoja Marketplace Africa or its licensors and is protected by law. Brand names and trademarks such as Apple, Samsung and Casio belong to their respective owners and are used only to identify genuine products. You may not copy, reproduce or commercially exploit our content without written permission.
Limitation of Liability
We are committed to doing right by our customers, and nothing in these terms excludes liability that cannot be excluded under Kenyan law, including liability for death or personal injury caused by negligence or for fraud. Beyond that, our liability for any claim connected to an order is limited to the amount you paid for that order, and we are not liable for indirect losses such as loss of profit, data or business opportunity, or for delays and failures caused by events beyond our reasonable control.
Website Use
We work to keep the website accurate, secure and available, but we cannot promise it will always be uninterrupted or error-free. We may update, suspend or withdraw parts of the website for maintenance or improvement. Any links to third-party websites are provided for convenience, and we are not responsible for their content or practices.
Prohibited Activities
You agree not to misuse the website. This includes attempting to gain unauthorised access to our systems or customer data, interfering with the website’s operation, placing fraudulent orders, using automated tools to scrape content or prices without permission, uploading malicious code, or using the website in any way that breaks Kenyan law.
Governing Law
These Terms & Conditions are governed by the laws of the Republic of Kenya, and any dispute arising from them or from a purchase is subject to the jurisdiction of the Kenyan courts. We would always rather resolve a concern directly, so please contact our support team first and give us the chance to put things right.
Changes to Terms
We may update these terms from time to time, for example to reflect changes in our services or in the law. The version published on this page, with its effective date, is the version that applies. Significant changes will be highlighted on the website, and the terms in force when you placed your order will apply to that order.
